These Terms of Service ("Terms") govern your access to and use of the Tziki website, browser extension, and web application (together, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. The Service
Tziki lets designers, developers, and teams pin comments and feedback directly on live websites and manage that feedback from a shared dashboard. The browser extension overlays comments inside your own browser; it does not modify, inject code into, or transmit the source of the websites you visit.
2. Eligibility and Accounts
- You must be at least 16 years old to use the Service.
- You are responsible for the accuracy of the information you provide when creating an account.
- You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
- You must notify us promptly of any unauthorised use of your account.
3. Acceptable Use
When using the Service, you agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose;
- Post or share content that is illegal, defamatory, infringing, or violates the rights of others;
- Attempt to gain unauthorised access to the Service, other accounts, or our systems;
- Interfere with or disrupt the integrity or performance of the Service;
- Reverse engineer, copy, or resell the Service except as permitted by law.
4. Your Content
You retain all rights to the comments, feedback, and other content you create using the Service ("Your Content"). You grant us a limited licence to host, store, and display Your Content solely for the purpose of providing the Service to you and your collaborators. You are responsible for Your Content and for ensuring you have the rights to share it.
5. Collaboration and Invitations
When you invite others to collaborate on a project, you are responsible for ensuring you have an appropriate basis to share their email address with us for that purpose. Invited collaborators may view project content and comments you share with them.
6. Privacy
Our collection and use of personal data in connection with the Service is described in our Privacy Policy and Cookie Policy. By using the Service, you acknowledge that we process personal data as described there.
7. Intellectual Property
The Service, including its software, design, and branding, is owned by Tziki and protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights in and to the Service.
8. Availability and Changes
We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted or error-free. We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of material changes that affect you.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that could cause harm to us, other users, or third parties. Upon termination, your right to use the Service ends, and we will handle your data as described in our Privacy Policy.

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Tziki will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the applicable laws of the jurisdiction in which Tziki operates, without regard to conflict-of-law principles. Any disputes will be subject to the competent courts of that jurisdiction, unless otherwise required by mandatory consumer protection law.
